Violet and Myrtle Curios operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Violet and Myrtle Curios is powered by Shopify, which enables us to provide the Services to you. 
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where Violet and Myrtle Curios is headquartered. You and Violet and Myrtle Curios consent to venue and personal jurisdiction in such courts.

SECTION 9: GENERAL TERMS AND CONDITIONS

1. Purpose and Use of Products

For enamel pins:
Our enamel pins are intended for ordinary display use.

For cosmetic products:
Cosmetic products are intended only for their ordinary cosmetic use.

For spiritual curios:
Spiritual and ritual products are offered as metaphysical curios for personal spiritual practice and inspiration. They are sold for entertainment purposes only. Any descriptions of traditional, historical, or folkloric uses are provided for informational purposes only. We make no guarantees regarding spiritual or magical efficacy, outcomes, or results. Additionally, our products are intended to complement - not replace - your own spiritual practice, personal effort, and decision-making.

2. Buyer Responsibility

By purchasing and using our products, you acknowledge that you assume responsibility for their safe handling and use. You agree to use all products safely and according to any instructions provided. To the fullest extent permitted by applicable law, Violet and Myrtle Curios LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or misuse of our products. In general, these guidelines are applicable to our products: 

  • Keep out of reach of children and pets.

  • External use only (where applicable).

  • Exercise care when handling and displaying enamel pins.

  • Do not ingest oils, perfumes, or other cosmetic products.

  • Discontinue use immediately if irritation occurs.

3. Not a Substitute for Professional Advice

The information provided on our website and in our product descriptions is for entertainment, holistic, and spiritual exploration. Our products and services are not intended to diagnose, treat, cure, or prevent any disease or health condition and should never be used as a substitute for professional legal, medical, or psychological advice. For cosmetic products, always conduct a small patch test first to test for any sensitivities. Body oils, perfumes, lip balms, and similar products are intended for external cosmetic use only. Discontinue use if irritation occurs. Avoid contact with eyes and broken skin.

4. Handmade Variations

Please note that due to the handmade origin of many of our products, slight variations in size, color, shape, and scent are completely normal and do not constitute a defect or grounds for a refund. In addition, product photographs are representative. Due to differences in monitor settings, colors may vary slightly.

5. Allergy Disclaimer

Products may contain botanical ingredients, essential oils, fragrance oils, nut oils, beeswax, or other common allergens. Customers are responsible for reviewing ingredient lists before use and performing a patch test when applying products for the first time.

6. Damages and Issues 

For enamel pins:
Limited edition items may not always be replaceable. If a replacement is unavailable, we may offer store credit or another appropriate resolution at our discretion.
We thoroughly inspect all items before shipping and pack them securely. If your package arrives damaged, incorrect, or incomplete, contact us within 48 hours of delivery with photographs of the item(s), packaging, and shipping label. We may request this information to assist in filing a carrier claim. We will review each situation individually and determine the most appropriate resolution.

For cosmetic/spiritual curios products: 
In the rare event a defect occurs, you must contact support@violetandmyrtle.com within 48 hours of delivery with clear photographic proof. We review these on a case-by-case basis and, if approved, may offer to replace the item, or, if it is a limited release, we may offer store credit instead of a refund. Once again, we may request photographs to assist in filing a carrier claim. However, we will do our utmost to make the situation right. We will review each situation individually and determine the most appropriate resolution.

7. Enamel Pin Production Time

For our enamel pin products, the production time will vary. Production timelines are estimates and are subject to change. Production updates will be communicated whenever possible through our website, email, or social media. 

Estimated production times for preorder enamel pins range from 4 - 6 months but may be extended due to manufacturing schedules, international shipping delays, quality control, customs processing, or other circumstances beyond our control. By purchasing a preorder item, you acknowledge these estimated timelines.

8. Cancellation Policy

All sales are final, and orders cannot be canceled once they have been placed.
